Despite the importance of extrapair copulation (EPC) in human evolution, almost nothing is known about the design features of EPC detection mechanisms. We tested for sex differences in EPC inference-making mechanisms in a sample of 203 young couples. Men made more accurate inferences (φmen = 0.66, φwomen = 0.46), and the ratio of positive errors to negative errors was higher for men than for women (1.22 vs. 0.18). Since some may have been reluctant to admit EPC behavior, we modeled how (...) underreporting could have influenced these results. These analyses indicated that it would take highly sex-differentiated levels of underreporting by subjects with trusting partners for there to be no real sex difference. Further analyses indicated that men may be less willing to harbor unresolved suspicions about their partners’ EPC behavior, which may explain the sex difference in accuracy. Finally, we estimated that women underreported their own EPC behavior (10%) more than men (0%). (shrink)

Transplantation of vital organs has been premised ethically and legally on "the dead donor rule" (DDR)—the requirement that donors are determined to be dead before these organs are procured. Nevertheless, scholars have argued cogently that donors of vital organs, including those diagnosed as "brain dead" and those declared dead according to cardiopulmonary criteria, are not in fact dead at the time that vital organs are being procured. In this article, we challenge the normative rationale for the DDR by rejecting the (...) underlying premise that it is necessarily wrong for physicians to cause the death of patients and the claim that abandoning this rule would exploit vulnerable patients. We contend that it is ethical to procure vital organs from living patients sustained on life support prior to treatment withdrawal, provided that there is valid consent for both withdrawing treatment and organ donation. However, the conservatism of medical ethics and practical concerns make it doubtful that the DDR will be abandoned in the near future. This leaves the current practice of organ transplantation based on the "moral fiction" that donors are dead when vital organs are procured. (shrink)

Conventional medical ethics and the law draw a bright line distinguishing the permitted practice of withdrawing life-sustaining treatment from the forbidden practice of active euthanasia by means of a lethal injection. When clinicians justifiably withdraw life-sustaining treatment, they allow patients to die but do not cause, intend, or have moral responsibility for, the patient's death. In contrast, physicians unjustifiably kill patients whenever they intentionally administer a lethal dose of medication. We argue that the differential moral assessment of these two practices (...) is based on a series of moral fictions – motivated false beliefs that erroneously characterize withdrawing life-sustaining treatment in order to bring accepted end-of-life practices in line with the prevailing moral norm that doctors must never kill patients. When these moral fictions are exposed, it becomes apparent that conventional medical ethics relating to end-of-life decisions is radically mistaken. (shrink)

Floridi and Sanders, seminal work, “On the morality of artificial agents” has catalyzed attention around the moral status of computer systems that perform tasks for humans, effectively acting as “artificial agents.” Floridi and Sanders argue that the class of entities considered moral agents can be expanded to include computers if we adopt the appropriate level of abstraction. In this paper we argue that the move to distinguish levels of abstraction is far from decisive on this issue. We also argue that (...) adopting certain levels of abstraction out of context can be dangerous when the level of abstraction obscures the humans who constitute computer systems. We arrive at this critique of Floridi and Sanders by examining the debate over the moral status of computer systems using the notion of interpretive flexibility. We frame the debate as a struggle over the meaning and significance of computer systems that behave independently, and not as a debate about the ‘true’ status of autonomous systems. Our analysis leads to the conclusion that while levels of abstraction are useful for particular purposes, when it comes to agency and responsibility, computer systems should be conceptualized and identified in ways that keep them tethered to the humans who create and deploy them. Electronic communication and commerce facilitate the collection of information about individual use of the Internet. Focusing on the case of Comet Systems Inc. and its data gathering practices, this paper explores the technical details of gathering personal information in databases in general and the special character of the privacy issue raised by 'anonymous' information about individual behavior on the Internet. The case analysis suggests new insights for our understanding of privacy and frames a discussion of policy alternatives with respect to (...) the privacy of Internet communication. (shrink)

Although informed consent is important in clinical research, questions persist regarding when it is necessary, what it requires, and how it should be obtained. The standard view in research ethics is that the function of informed consent is to respect individual autonomy. However, consent processes are multidimensional and serve other ethical functions as well. These functions deserve particular attention when barriers to consent exist. We argue that consent serves seven ethically important and conceptually distinct functions. The first four functions pertain (...) principally to individual participants: (1) providing transparency; (2) allowing control and authorization; (3) promoting concordance with participants' values; and (4) protecting and promoting welfare interests. Three other functions are systemic or policy focused: (5) promoting trust; (6) satisfying regulatory requirements; and (7) promoting integrity in research. Reframing consent around these functions can guide approaches to consent that are context sensitive and that maximize achievable goals. (shrink)

The philosophers at the University of Padua during the late Middle Ages and Renaissance arc attracting much renewed interest. This study makes accessible again the logical philosophy of Girolamo Balduino, professor at Padua during the second quarter (...) of the sixteenth century. Like other thinkers of his period, 13alduino follows the logic of Aristotle, and looks for progress within the ancient and mediaeval tradition, not for radically new doctrines. He continues the traditional interpretation of Aristotle by Averroes, for whom logic is only an instrumental habitus, a tool or method of demonstration. About the final contribution of the school of Padua to the improvement of Aristotelian logic was the doctrine of regressive demonstration, where demonstration terminates in or discloses the definition. Zabarella's well-known teaching on this point seems to be derived entirely from Balduino. Contrary to the interpretation of Cassirer, followed by Randall, this regressive demonstration is not a universal method of inquiry and is not at all like, and not the historical source of, the new method of Galileo. Papuli's book is solidly based on the original Latin texts, in notes, which are of great value in view of the fact that Balduino's works have been out of print since 1573. Not all of Papuli's interpretations are beyond criticism (e.g., p. 296), but he has done a service in enabling us to reestablish contact with one of the last significant commentators on Aristotle's logic. Pp. 196+22 facsimile illustrations) Giulio Cesare Vanini (1585-1619) ranks with Giordano Bruno as a modern hero of freedom of philosophical expression. He was tortured and then burned at the stake in Toulouse at the age of thirty-four, because of the unorthodoxy of his views. For this reason, he has drawn more attention than is perhaps deserved on the basis of his rather mediocre writings, which are little more than a tissue of plagiarisms culled from Pomponazzi, Cardano, J. C. Scaliger, and others. In this volume, Emile Namer has collected the scattered documents dealing with Vanini's life and activities. This is a valuable service, for it should enable scholars to disentangle fact from fiction and reality from myth. There has been so much heated discussion regarding Vanini that it is now time that someone should attempt to establish the precise facts and to reevaluate Vanini's place in intellectual history. In the past, writings about him have been governed more often by emotion than by reason. Namer prints documents from Naples, London, Paris, Simancas, and Toulouse. Some of these have been printed before in various journal articles, but it is valuable to have them all together in a single volume. In addition, he prints relevant excerpts concerning--as one of them put it--le douzi~me apostre de Satan, including material from Mersenne, Garasse, and others. He also includes a series of facsimiles of sample pages from the documents which he prints. All in all Namer's work is competently 250 HISTORY OF PHILOSOPHY done, though perhaps a bit more annotation to put the documents in historical perspective would have been desirable. In any case this little volume must be one of the bases for any future serious biographical or interpretative studies dealing with Vanini. Moreover, it shouM also be useful for scholars dealing with more general questions of seventeenth-century intellectual, religious, and social history. Unfortunately, there is no index, nor bibliography of earlier literature on Vanini, and the Introduction is perhaps too brief to orient the reader who has little previous knowledge of Vanini. In this paper we prove that it is relatively consistent with ZFC to have b < z where b is, as usual, smallest cardinality of an unbounded family in ωω. This answers a question raised by Zapletal. We also show that it is relatively consistent with ZFC that there exists X ⊆ (...) 2ω such that the Borel order of X is bounded but there exists a relatively analytic subset of X which is not relatively coanalytic. G. A. Cohen incisively argued that our judgments of social justice should fit our convictions about how to interact with others in our personal lives. Ironically, the ordinary morality of cooperation invoked in his last book undermines his favored principle of equality, and supports John Rawls' reliance on a relevantly impartial choice promoting appropriate fundamental interests as a basis for distributive standards. His further objections to Rawls' account of distributive justice neglect the role of social relations in establishing the proper (...) scope of that impartiality and the moral force of Rawls' taxonomy of non-ideal societies. In contrast, the powerful evocation of goods of community at the end of Cohen's last book points to a genuine inadequacy. Conscientious fellow-citizens must take account of the impact of their political choices on options for sharing and caring. In finding a proper balance between these goods and competing individualist concerns, the original position is of too little use to sustain Rawls' assessment of his conception of justice as complete. In the face of our strong moral convictions about how to live together, both Cohen's luck egalitarianism and Rawls' barriers between aspirations to community and political choice must give way. New York: Oxford University Press, 1990. Pp. xii + 764. $24.95 (paper). The Achievement of John Henry Newman. By IAN KER. Notre Dame: University (...) of Notre Dame Press, 1990. Pp. x + 209. $24.95 (cloth). Ian Ker has inherited the mantle of the late Charles Stephen Dessain as the finest textual expositor of the Newman corpus, and Ker's biography should become a standard reference tool in the field. Ker ap· prenticed under Dessain in the production of the monumental (31volume ) Letters and Diaries, and his biography shows his command of the materials of that as yet unfinished project. Ker's hook joins the biographies of W. Ward (1912) and M. Trevor (1962) as significant "lives of Newman" to consider, and it addresses their earlier shortcomings : Ward's inadequate appraisal of the Anglican Newman and Trevor's unconcern for Newman's theological writings. Of Newman's intellectual contribution, Ker's treatment is similar to Dessain's John Henry Newman, an exposition of the major themes and intellectual moves, and theologically-minded inquirers need read both. Ker offers the hook as a personal life, a literary appraisal, and an intellectual study. The personal life and literary analysis are ably carried off; Ker's background in English literature and his editorial work on the letters have served him well. The intellectual study takes the form of synopses of Newman's hooks and articles, which are woven into the chronological narrative of the life. This aspect of Ker's hook is by no means "the theological achievement of JHN" (cf. Tracy's work on Lonergan); such a project still awaits Newman studies and someone of the conceptual breadth of the late Jan Walgrave to achieve it. Ker provides accurate and readable summaries of Newman's writings, and if a biography is meant to introduce the sundry aspects of a person, especially a complex thinker like Newman, then Ker's treatment of the intellectual aspect offers a fine introduction. I shall consider these three dimensions of the biography, and first the personal life. Newman considered that a person's life is best told 888 BOOK REVIEWS through that person's correspondence. Ker's biography is approached chronologically, and Newman's published letters guide the tale. Newman 's advice is particularly apropos for his own biographer, since Newman 's hooks and articles often displayed a "reserve" in which his true feelings were couched and nuanced. His letters, especially to confidants, were candid and often hard-hitting, as when he described the Curia in these words: " And who is Propaganda? one sharp man of business, who works day and night, and dispatches his work quick off, to the East and West, a high dignitary, [perhaps an Archbishop], hut after all little more than a clerk... with two or.three clerks under him " (p. 519). (Ker displays some reserve himself, omitting Newman's episcopal aside.) Ker's use of the letters is most revealing during Newman's Roman Catholic period when he encountered opposition from Archbishop Manning and W. G. Ward in England, from Archbishop Cullen in Dublin, and from Cardinal Barnaho in Rome. One senses how the laity rallied round him. Some of Newman's most pungent thoughts on ·theological freedom, on the suspicious nature of the clergy toward educated laity, on the wherewithal to make an institution a genuine university, on the role of patience and.trust in God when authorities are hearing down, are to he found in Ker's choice of letters. With so much material to mine-Newman wrote 20,000 letters-it is understandable that Ker does not include, save rarely, what Newman's opponents were thinking. Ker's account of Newman's Anglican period is equally illuminating, and indeed it is a highlight of the biography. With the resurgence in recent years of Hegelian studies a veritable spate of new translations have appeared of that philosopher’s works. For a long time we have had Wallace’s inimitable version of the lesser Logic and the main text of the Philosophy of Mind. We have had also Johnson and Struther’s translation of the greater Logic, Baillie’s Phenomenology, the History of Philosophy done by E. S. Haldane and The Philosophy of History by Sibree, not to mention various fragmentary editions of (...) the Introduction. Besides these there have been Sir Malcolm Knox’s excellent translations of the Rechtsphilosophie and, more recently, of Lectures on Aesthetics. But in the last few years A. V. Miller has given us a new and much improved version of the Science of Logic and the hitherto untranslated Philosophy of Nature as well as a new and revised edition of Wallace’s Encyclopaedia Logic and his Philosophy of Mind with the addition now of the Zusätze in English. At the same time another translation of the Naturphilosophie by Petry appeared, with voluminous historical and explanatory notes. Now attention is being given to the earlier works, and new translations have appeared, under the imprint of the State University of New York Press, of Hegel’s Differenz des Fichteschen und Schellingschen Systems der Philosophic and Glauben und Wissen, by Walter Cerf and Henry S.
